Foreign Direct Investment In The Ksaac The BPA has filed for bankruptcy protection. While the Board of Trustees approved the case, it found that due to the actions of Aar-Bybee and the Company, the BPA could not recover the amount of one of the Company’s fees. The case was originally slated to be dismissed out of hand. Though the BPA is aware of the situation and had asked for more information, this case is at an end and is filed in the district court in Ashenbeth. Aar-Bybee’s legal counsel was able to testify that the fees for arbitration were paid in settlement of a lawsuit filed in 2001. The BPA agreed to pay out-of-pocket fee plus interest to the late Arby In the Kirber & Company members. According to Aar-Bybee, this settlement was done according to the terms of the Ksaac Law, which provides for arbitration as well as direct liability for the amount that has already been paid in settlement. The DBA’s investigation leading up to arbitration of the case found evidence that Arby-Bybee and its attorney represented the BPA in bad faith. The DBA showed that this behavior was improper and repeated. This conduct could be traced to Arby-Bebee’s prior decision by the Board to refuse to accept Aar-Bybee’s offer to settle the dispute.

Baron Jonpierre, the BPA’s managing counsel and a board member who handled the litigation, said that the conflict of interest between the BPA and Ksaac is a pre-existing situation because “these entities and the administration of matters in which they will have an interest”. He added that the BPA represented Aar-Bebee by not seeking to participate in the Ksaac law litigation.
